No charges in officer’s injury at sing-a-long

The Dane County district attorney has declined to file charges against a Capitol demonstrator who was accused of injuring a police officer.

DA Ismael Ozanne said there isn’t enough evidence to show Damon Terrell intentionally injured Capitol police officer James Brooks in August when Terrell was arrested during a sing-a-long demonstration.

Terrell was held for three days on potential charges of felony battery and resisting arrest.

Officer Brooks said Terrell resisted arrest when he refused to leave the Capitol and was taken to the floor to handcuff. Brooks says he suffered cuts and scrapes as Terrell resisted. Ozanne said the evidence was not enough to warrant charges. The DA told the State Journal Terrell was moving away when he was told to leave.
